Return Policy

Products purchased remotely can be returned according to GEO 34/2014. The consumer has the right to notify the trader in writing that he/she withdraws from the purchase, without penalty and without giving a reason, within 14 days of receiving the product or, in the case of services, from the conclusion of the contract. The return of the products will be at the customer's expense, within 14 days of terminating the contract. It is recommended to use the same transport service used for receiving the products.

AutoMIV.ro will refund the order value as soon as possible after receiving the returned product.

Definition of sales contract: any contract under which the professional transfers or undertakes to transfer ownership of products to the consumer, and the consumer pays or undertakes to pay the price thereof, including any contract that has as its object both products and services.

The conclusion of the contract takes place when the tax invoice is issued and not when the order is launched or the automatic confirmation of receipt is issued.

The exercise of the right of withdrawal terminates the obligations of the contractual parties. The returned product must be in the same condition in which it was delivered (in the original packaging with all accessories, with intact labels and accompanying documents). Products that show physical changes, blows, chips, scratches, shocks, traces of excessive use and/or unauthorized interventions, etc. are not accepted for return.

The provisions of GEO 34/2014 apply only to the consumer defined as any natural person or group of natural persons established in associations as defined in art. 2 point 2 of GEO 21/1992 on consumer protection, republished, with subsequent amendments and completions.

The consumer is only liable for any diminished value of the goods resulting from their handling, other than what is necessary to establish the nature, characteristics and functioning of the goods. According to Directive 2011/83/EU, point (47) of the presentation: in order to establish the nature, characteristics and functioning of the goods, the consumer should handle and inspect them in the same way as he would be allowed to do so in a shop; for example, the consumer should only try on an item of clothing, not wear it.

Some products are marked with a seal applied by the manufacturer on the packaging. This seal is not necessarily present, its presence being specific to the manufacturer. The presence of the seal is not mandatory to demonstrate that the product is exactly in the form and conditions in which it was released by the manufacturer. Damage to the seal does not bring any limitation to the right to withdraw from the contract.

The consumer informs AutoMIV .ro (Estetic Shop SRL) of the decision to withdraw from the contract by one of the following options: model form or an unequivocal statement made on a durable medium (paper, email or fax). The consumer has 14 days from receipt of the products to announce the withdrawal from the contract.

Obligations of AutoMIV.ro.

Full refund of the amounts received as payment, including delivery costs in cases: the delivered product does not correspond to the specifications on the site, the product is non-functional within the first 48 hours (2 business days) of receipt, the wrong product is delivered (except in the case where the consumer has explicitly chosen a type of delivery other than standard delivery). The refund of the amounts will be made using the same reasonably applicable payment methods (in the case of cash on delivery payment, the refund will be made by transfer to a bank account unambiguously transmitted by the consumer). The refund obligation is fulfilled within 5 business days of receipt of the products.

Obligations of the consumer

The products are handed over to AutoMIV.ro personally or handed over to an authorized person (designated courier) without undue delay and within a maximum of 14 days from the announcement of the decision to withdraw from the contract. The consumer bears the costs of return. The consumer is only responsible for the diminution in value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and functioning of the products.

Products that show physical changes, knocks, chips, scratches, shocks (not reported as aesthetic defects from the factory within the first 48 hours of receiving the product);

You can request the return of products in the following cases:

  • The product delivered does not meet the specifications on the site. You can request its return for replacement or full refund (if the product is no longer available).
  • Non-functional product within the first 48 hours (2 business days) of receipt. If the purchased product was delivered non-functional or has manufacturing defects, it will be replaced with a functional product, following written notification or by presentation at the headquarters within 48 hours of receiving the product
  • Product in damaged package. For products whose packages show visible damage upon receipt by courier, we recommend that you refuse their receipt. For evidence, the package can be photographed and a report can be drawn up together with the courier company representative stating the condition of the package at the time of delivery. The risk of loss or damage to the products is fully transferred to you when you take physical possession of the product. Any subsequent complaint will not be taken into account. In the event that a carrier appointed by the consumer is used, the risk is transferred at the time of delivery of the products to the carrier.
  • Wrongly delivered products . If a different product than the one ordered was delivered.

The return costs for the situations presented above (not in the case of canceling the purchase) are the responsibility of our store.

RETURN FORM

Any change in the condition of the products or damage to their original packaging that makes it impossible to sell the product as new, automatically leads to the application of a return procedure subject to administrative fees to return the products to the condition in which they were delivered; the fees are between 0 and 50% of the initial value of the product. The amount of the administrative fee will be communicated to the customer upon receipt of the damaged/modified products.
